Thursday, H&M withdrew that suit, telling The Daily Beast that "H&M respects the creativity and uniqueness of artists, no matter the medium. We should have acted differently in our approach to this matter. It was never our intention to set a precedent concerning public art or to influence the debate on the legality of street art. As a result, we are withdrawing the complaint filed in court. We are currently reaching out directly to the artist in question to come up with a solution." “H&M is about to start a war with people who gladly destroy private property for fun in their free time.”
After H&M had filed its now withdrawn suit Monday, dozens of graffiti writers and aerosol fans flooded Instagram in an unprecedented show of support in a concerted campaign calling for a boycott of the store. “H&M is about to start a war with people who gladly destroy private property for fun in their free time,” opined one supporter on Instagrambefore the company's reversal Thursday. “So dumb. At least it will be entertaining to watch.” “This action taken by H&M is a full out assault on artists' rights and we must raise our voices,” wrote graffiti author and scholar Alan KET. “This could render millions of murals and important pieces of artwork worldwide completely unprotected and available for corporate use, without any payment or permission needed whatsoever. We must not allow this company to use our artwork and appropriate our culture to sell their products, for their own financial gains, while at the same time allow them to devalue and delegitimize our artwork, our culture, and everything we work for.”

Why?? So they can shoot their comercial in front of the artwork and still no pay the artists? I think Graffiti and Street Art artists have manage to do their artwork without H&M walls. Keep your walls H&M the Art community does not need them unless you pay for the artwork.

Clothing retailer H&M has filed a complaint for declaratory judgment after being threatened with legal action over its use of graffiti art in a marketing campaign.
The claim was filed on Friday, March 9 at the US District Court for the Eastern District of New York.
Jason Williams, who goes under the moniker REVOK, threatened H&M with litigation after the retailer featured an image of graffiti which he claimed to have created in its online advertising. Williams allegedly demanded compensation from H&M.
In the claim, H&M said that Williams accused the retailer of copyright infringement, negligence and unfair competition.
H&M responded by saying that Williams “does not own or possess any copyright rights in certain graffiti that was painted on New York City property without the permission of the city of New York”
H&M is also seeking a declaration that its use of the graffiti does not constitute unfair competition or negligence.
The graffiti is on a handball court in the Williamsburg area of Brooklyn. H&M hired a production company to conduct a photo shoot and promotional video at the court in October 2017.
In its claim, H&M said that a member of the production company sent an email to the New York City Department of Parks and Recreation asking whether it needs to pay royalties for the use of the graffiti. In its reply, the department reportedly said that the graffiti should not be on the wall in the first place.
H&M said it received a letter from Williams’ representatives in January 2018 claiming that it “included Mr Williams’ original artwork in an advertising campaign for H&M products without his permission or knowledge”, constituting copyright infringement.
The retailer responded by claiming that the graffiti was unauthorised and constitutes vandalism. As a result, it alleged Williams does not have any copyright because “copyright protection is a privilege that does not extend to illegally created works”.

In a recent campaign for its New Routine sportswear, H&M featured a photograph and video of a model backflipping off a wall with graffiti. Los Angeles-based artist Jason “Revok” Williams recognized the wavy black design as one he had spray-painted on the wall of a handball court in Brooklyn, and, in January, his lawyer sent the retailer a cease-and-desist letter asking for it to refrain from infringing on his client’s copyrighted work.
H&M’s initial reaction was to file a lawsuit against Williams earlier this week, claiming that the product of an illegal act could not be protected by copyright law. But after members and supporters of the street-art community urged their social media followers to boycott H&M — a graphic shared by rock band Portugal. The Man called the suit a “full out assault on artists’ rights” — the retailer backed down.
Wednesday my eldest sister die, she had 5 children and 4 grandchildren. They all were around her dead bed. I would say that was a nice and unnecessary way to die. Nice because all of her family was there. And unnecessary because she die of ovarian cancer. I am posting this to tell my female followers to have their yearly check up; and if you are not happy with the results, look for another doctor, yeah nowadays if one doesn't have insurance it gets expensive, but the alternative is way more expensive. Third consecutive year I lose and loose somebody in my family, second to cancer. Life is Beautiful, Precious and Short. Enjoy it.
